CONTEST SCHEDULE:

Entry Period: May 5, 2025, at 12:00 AM Eastern Time (“EST”) through June 22, 2025 at 11:59 PM EST (“Entry Period”).

The Entry Period consists of the two (2) phases (each, a “Phase”, collectively, the “Phases”) as set forth in the chart below:

In all cases, the computer of Sponsor (as defined below) is the official timekeeping device of this Contest.

ELIGIBILITY: The Repair Challenge (“Contest”) is open only to legal residents of Canada who have reached the legal age of majority in their province/territory of residence at the time of entry (“Entrant”). Employees, as well as the immediate families (defined for the purposes of this Contest as: spouses and parents, in-laws, siblings and children and their respective spouses, regardless of where they reside) and members of the same household of such employees (whether or not related), of WD-40 Company (Canada) Ltd. (“WD-40 Company” or “Sponsor”) and its respective parents, divisions, affiliates, dealers, subsidiaries and advertising and promotion agencies, and companies involved in the implementation and execution of this Contest (collectively, the “Contest Entities”) are not eligible to enter or win the prize. Contest is void where prohibited by law.

AGREEMENT TO THE OFFICIAL RULES: By participating in this Contest, each Entrant fully and unconditionally agrees to and accepts these “Official Rules” and the decisions of Sponsor, which are final and binding in all matters related to this Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.

ENTRY SUBMISSION: During the Submission Phase, eligible individuals may enter this Contest without having to purchase anything by visiting https://repairchallenge.wd40.ca/ during the Entry Period and completing the free online entry form in accordance with the instructions provided and including the submission of photographic (or video) documentation of your project showing the repaired item and a detailed written description of the steps taken to repair the item (“Submission”). All required fields on the online entry form must be completed. Incomplete entries will not be accepted and will be automatically rejected. Entrants must be the registered subscriber of the email account from which the entry is made. By submitting your entry, you agree that the Submission conforms to the guidelines and content restrictions set forth above and that Sponsor, in its sole discretion, may remove the Submission and disqualify you from this Contest if it believes, in its sole discretion, that the Submission fails to conform to such guidelines and restrictions.

By entering, Entrants represent and warrant that the Submission that they submit:

• Is their own original creation;

• Does not infringe any other person’s or entity’s rights;

• Has not been submitted previously in a contest or promotion of any kind;

• Does not contain any reference to or likeness of any identifiable third parties, unless consent has been obtained from all such individuals and their parent/legal guardian if they are under the age of majority in their jurisdiction of residence;

• Will not give rise to any claims whatsoever, including, without limitation, claims of infringement, invasion of privacy or publicity; and

• Is not defamatory, trade libelous, pornographic or obscene, and further that such materials will not contain, depict, include, discuss or involve, without limitation, any of the following: nudity; alcohol/drug consumption or smoking; explicit or graphic sexual activity, or sexual innuendo; crude, vulgar or offensive language and/or symbols; derogatory characterizations of any ethnic, racial, sexual, religious or other groups (including, without limitation, any competitors of Sponsor); content that endorses, condones and/or discusses any illegal, inappropriate or risky behaviour or conduct; personal information of individuals, including, without limitation, names, telephone numbers and addresses (physical or electronic); commercial messages, comparisons or solicitations for products or services other than products of Sponsor; any identifiable third-party products, trade-marks, brands and/or logos, other than those of Sponsor (e.g. any clothing worn and/or products appearing in your submission must not contain any visible logos, trade-marks or other third-party materials unless the appropriate consents have been obtained --- note: all identifiable third-party products, trade-marks, brands and/or logos for which consent has not been obtained by the entrant must be blurred out so as to be unrecognizable); conduct or other activities in violation of these Official Rules; and/or any other materials that are or could be considered inappropriate, unsuitable or offensive, all as determined by Sponsor in its sole and absolute discretion.

Entries must be submitted by the original creator. The Submission created by someone other than you but submitted by you will be disqualified. You must be the sole owner of the copyright of any Submission submitted. Your submission of each Submission is your guarantee that you are the author and copyright holder of such Submission.

By entering, Entrants grant a non-exclusive, worldwide, royalty-free, perpetual license to Sponsor to edit, adapt, make derivative works from, broadcast, publish and otherwise use any or all of the descriptions and/or photo(s) and/or video(s) included with the Submission, and may use them for advertising, promotional and/or any other purpose in any and all media now or hereafter devised worldwide in perpetuity without additional compensation, notification or permission, unless prohibited by law. By entering this Contest, Entrants further agree to: (a) have their submitted Submission used and displayed, either singularly or in combination with others and in any size, on Sponsor’s website and on the websites, social media, and print materials of Sponsor without any fee or other form of compensation due at any time for so long as desired by Sponsor; (b) waive all moral rights in and to their submitted Submission in favour of Sponsor (and anyone authorized by Sponsor to use such materials); and (c) agrees to release and hold harmless Sponsor and all of the other Contest Entities from and against any and all claims, damages, liabilities, costs, and expenses arising from use of their submitted Submission, including, without limitation, any claim based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related or other cause of action whatsoever. Credits, descriptions or titles, if any, used with the Submission are in Sponsor’s sole discretion.  In the event that ownership of any Submission submitted is challenged in any manner by any person, Sponsor may disqualify that Submission and will discontinue use of the Submission.

Online access and an email account are required in order to participate in this Contest. Many public libraries, retail businesses and others offer free access to computers and a number of Internet service providers and other companies offer free email accounts.

ENTRY RESTRICTIONS: There is no limit on the number of entries, however, only one entry per project and each project entered must be unique. Each Entrant must submit on behalf of oneself and not use another person’s email address to enter. Violation of this limit (e.g., submission of more than one (1) entry via one or more than one email address) will result in voiding of all entries after the initial entry. All submitted entry materials, including descriptions and/or photo(s) and/or video(s) submitted, become the property of Sponsor, and none will be acknowledged or returned. Automated entries (including, but not limited to, entries made using any script, macro, bot, or sweepstakes service) will result in disqualification and all entries by such person shall be void. In the event of a dispute over the identity of an Entrant, entry will be deemed made by the authorized account holder of the email address provided on the entry form. The authorized account holder is the natural person who is assigned to the email address by an Internet access provider, online service provider, or other organization that is responsible for assigning email addresses or the domain associated with the email address in question. Contest Entities are not liable for incomplete, corrupted, garbled, defective, inaccessible, irregular, lost, late or misdirected entries, regardless of cause, including without limitation, videos that cannot be opened or viewed by Sponsor for any reason. No third-party entry or entry through sweepstakes service permitted. Any individual who attempts or otherwise encourages, directly or indirectly, the entry of multiple or false contact information under multiple identities, multiple email accounts, or uses any device or artifice to enter or encourage, directly or indirectly, multiple or false entries, as determined by Sponsor, will be disqualified. If, in Sponsor’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of this Contest, or if a computer virus, bug, unauthorized intervention, fraud, technical difficulties, or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of this Contest, and/or this Contest is not capable of being conducted as described in these Official Rules, Sponsor shall have the right, at its sole discretion, to disqualify any individual who tampers with the entry process and to void any entries submitted fraudulently, and/or to cancel, terminate, modify or suspend this Contest, and conduct a random drawing to select the prize winner from all non-suspect entries received prior to action taken, or as otherwise deemed fair and appropriate by Sponsor.

SELECTION OF WINNERS; ODDS AND SKILL TESTING QUESTION: Winners will be determined via the process set forth below.

During the Judging Phase, a panel of judges (the “Judges”) appointed by Sponsor will judge each eligible entry on the basis of the following weighted criteria:

For photographic and video content, showcasing the before AND after condition of the project/item repaired, and clearly showing the item(s) repaired,	60%
For showcasing a WD-40® Brand product in use,	15%
For overall quality of the content	15%
For a description of the project clearly identifying the steps taken to repair	10%

Each Entry will be given a score (the “Score”) by the Judges. Odds of being selected will depend on the caliber of each eligible entry. The Entrants associated with the top eligible entries based on Score (as determined by the Judges, in their sole discretion) will each be selected as an eligible winner. In the event of a tie between two (2) or more eligible entries based on Score, the Entrant associated with the eligible entry – from amongst all such eligible entries that are tied – with the highest score on Criteria 1 (followed in the event of a further tie by Criteria 2, then Criteria 3, then Criteria 4) will be selected as the eligible winner. In the event of an exact tie based on all criteria, a new panel of judges will be appointed by Sponsor to break the tie in accordance with the preceding procedure. All judging decisions are final.

WINNERS NOTIFICATION: The winner will be notified by email as provided by Entrant and will be required to complete and return a Declaration of Eligibility and Liability/Publicity Release (“Declaration and Release”), and any other additional documents requested by Sponsor within five (5) business days of receipt or such shorter time as may be indicated in the prize notification documents. In the event of noncompliance with these Official Rules and/or if a potential winner cannot be contacted by Sponsor, the prize will be forfeited, and an alternate winner may, in the sole discretion of Sponsor and time-permitting, be selected by judges from the remaining eligible entries. Without limiting the foregoing, Entrants understand and agree that winner’s signature on the Declaration and Release (or other documents) in electronic form shall have the same legal force and effect as a hand-signed paper copy of same. 

PRIZES:

1.      One (1) grand prize of $5,000 CAD cash (in for form of a cheque) will be awarded.

2.      One (1) second place prize of $3,000 CAD cash (in for form of a cheque) will be awarded.

3.      One (1) third place prize of $2,000 CAD cash (in for form of a cheque) will be awarded.

4.      One (1) fourth place prize of $1,500 CAD cash (in for form of a cheque) will be awarded.

5.      One (1) fifth place prize of $1,000 CAD cash (in for form of a cheque) will be awarded.

6.      Five (5) sixth place prize of a Yeti Tundra® 45 Hard Cooler (charcoal grey) (approximate retail value $400 CAD each Yeti Tundra® 45 Hard Cooler (charcoal grey)

There will only be one (1) prize per winner. Lost or stolen prize will not be replaced. No assignment, transfer, conversion to cash or cash redemption or substitution of the prize is permitted, except Sponsor reserves the right to substitute the prize with a prize of equal or greater value should the prize become unavailable. All prize details are at the sole discretion of Sponsor. The winner agrees to accept the prize “as is”, and Entrants hereby acknowledge that Sponsor has neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the prize, including express warranties (if any) provided exclusively by a prize supplier that are sent along with the prize. Total approximate retail value of all prizes is $14,500 CAD Any valuation of the prize(s) stated above is based on available information provided to Sponsor and the value of any prize awarded to a winner may be reported for tax purposes as required by law. The winner(s) will be solely responsible for all applicable state, federal, provincial, territorial, and local taxes associated with the acceptance and use of any awarded prize. Each Entrant acknowledges that Sponsor shall not be required under any circumstances to award more prizes than the number of available prizes as set out in these Official Rules.

GENERAL CONDITIONS: Sponsor and its agencies make no representation or warranty of any kind, including but not limited to the representation of merchantability or fitness for intended use, with regard to any elements of the prize(s). Neither Contest Entities nor any service providers are responsible for incorrect or inaccurate transcription of entry information, or any human or other error, technical malfunctions, lost/delayed data, omission, interruption, deletion, defect, failures of any computer equipment, software, inability to access any online service or website (including the Contest Website), or any injury or damage to Entrants’ computer or mobile device related to or resulting from participation in this Contest. CAUTION: ANY ATTEMPT BY ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE, TAMPER WITH THE ENTRY PROCESS, DEFRAUD SPONSOR, OR OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO COOPERATE IN THE PROSECUTION OF ANY SUCH INDIVIDUAL(S) AND TO PURSUE ALL REMEDIES TO THE FULLEST EXTENT PERMITTED BY LAW. Failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If for any reason this Contest or any part of it is not capable of being executed as planned, or infection by computer virus, bugs, tampering, unauthorized intervention, fraud, action of Entrants, technical failures or any other causes which, in the opinion of Sponsor, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor reserves the right at its sole discretion to cancel this Contest and/or any part of it and not award any of the prize(s) referenced herein. In the event of any cancellation, termination or suspension, notice thereof will be posted on the Contest Website. Entries not complying with all rules are subject to disqualification. 

RELEASE:  By participating in this Contest, each Entrant fully releases Contest Entities and their respective directors, officers, agents and employees, from any and all liability for any actions, claims, costs, debts, expenses, fees, injuries, losses or damages of any kind arising out of or in any way related to the Entrant’s participation in this Contest (“Claims”). This Release expressly applies to all claims, costs, fees, injuries, losses or damages of any kind relating to or arising out of unauthorized access to, or disclosure of, any personally identifiable information supplied by the Entrant during the course of this Contest as well as the acceptance, possession, use, or misuse of the prize(s) and, if selected as a potential winner, Entrant agrees to sign and deliver the Declaration and Release before receiving their prize.

THE PARTIES AGREE, ACKNOWLEDGE AND UNDERSTAND THAT CONTEST ENTITIES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR LOST PROFIT DAMAGES. THE PARTIES AGREE, ACKNOWLEDGE AND UNDERSTAND THAT CONTEST ENTITIES’ TOTAL AGGREGATE LIABILITY FOR ANY MATTER ARISING FROM OR RELATED TO THIS CONTEST, WHETHER IN CONTRACT, TORT, OR UNDER ANY THEORY OF LIABILITY, SHALL NOT EXCEED THE AMOUNT OF THE ACTUAL OUT-OF-POCKET COSTS INCURRED BY ENTRANT ASSOCIATED WITH ENTERING THIS CONTEST.

CALIFORNIA SECTION 1542 RELEASE:  By participating in this Contest, each Entrant understands and agrees that they are specifically and expressly waiving any and all rights under Section 1542 of the California Civil Code, or any analogous (in whole or in part) federal, provincial, territorial, state or municipal law, rule, regulation or ordinance.  Section 1542 provides as follows:

A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, AND THAT IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.

GOVERNING LAW/JURISDICTION/DISPUTE RESOLUTION: Entrants agree that (a) any and all disputes, claims and causes of action arising out of, or connected with, this Contest or the awarding of the Prizes shall, to the fullest extent permitted by law, be resolved individually, without resort to any form of class action, and exclusively by the courts located in the Province of Ontario; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest but in no event attorneys’ fees. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, Entrants’ rights and obligations, or the rights and obligations of Sponsor in connection with this Contest, shall be governed by, and construed in accordance with, the laws of the Province of Ontario, without giving effect to any choice of law or conflict of law rules (whether of the Province of Ontario or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Province of Ontario.

PUBLICITY; GENERAL:  Each Entrant grants Sponsor and its designees a perpetual, worldwide, royalty-free license to use, broadcast, publish and otherwise use Entrant’s name, company name, address of residence, address of company, statements regarding this Contest, image, photograph, video, voice and/or likeness for advertising, promotional and/or any other purpose in any and all media now or hereafter devised worldwide in perpetuity without additional compensation, notification or permission, unless prohibited by law. This Contest and all entries are subject to all applicable federal, state, provincial, territorial and local laws and regulations. Void where prohibited by law.

Sponsor reserves the right, in its sole discretion, to adjust any of the dates, timeframes and/or other mechanics stipulated in these Official Rules, to the extent deemed necessary by Sponsor, for purposes of verifying compliance by any Entrant, entry and/or other information with these Official Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of Sponsor, in its sole discretion, affect the proper administration of the Contest as contemplated in these Official Rules, or for any other reason.

In the event of any discrepancy or inconsistency between the terms and conditions of these English Official Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to, point of sale, television, print, online or other advertising, the French version of these Official Rules and/or any instructions or interpretations of these Official Rules given by any representative of Sponsor, the terms and conditions of these English Official Rules shall prevail, govern and control to the fullest extent permitted by law. 

ANYONE DEEMED BY SPONSOR TO BE IN VIOLATION OF SPONSOR’S INTERPRETATION OF THE LETTER AND/OR SPIRIT OF THESE OFFICIAL RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE DISCRETION OF SPONSOR AT ANY TIME.

(« WD-40 Company » ou « commanditaire ») et de ses sociétés mères, divisions, sociétés affiliées, concessionnaires, filiales et agences de publicité et de promotion respectives, ainsi que des sociétés impliquées dans la mise en œuvre et l'exécution du présent concours (collectivement, les « Entités du concours ») ne sont pas admissibles à participer ou gagner le prix. Le concours est nul là où la loi l'interdit.

ACCEPTATION DU RÈGLEMENT OFFICIEL : En participant à ce concours, chaque participant accepte pleinement et sans condition le présent « règlement officiel » et les décisions du commanditaire, qui sont finales et contraignantes pour toutes les questions liées à ce concours. L'obtention d'un prix est subordonnée au respect de toutes les conditions énoncées dans le présent document.

SOUMISSION DES PARTICIPATIONS : Pendant la phase de soumission, les personnes admissibles peuvent participer au présent concours sans avoir à acheter quoi que ce soit en visitant https://repairchallenge.wd40.ca/ pendant la période de participation et en remplissant le formulaire de participation en ligne gratuit conformément aux instructions fournies et en soumettant une documentation photographique (ou vidéo) de votre projet montrant l'objet réparé et une description écrite détaillée des étapes suivies pour réparer l'objet (« Soumission »). Tous les champs obligatoires du formulaire de participation en ligne doivent être remplis. Les participations incomplètes ne seront pas acceptées et seront automatiquement rejetées. Les participants doivent être l'abonné enregistré du compte de courrier électronique à partir duquel la participation est effectuée. En soumettant votre participation, vous acceptez que le Soumission soit conforme aux lignes directrices et aux restrictions de contenu énoncées ci-dessus et que le commanditaire, à sa seule discrétion, puisse retirer le Soumission et vous disqualifier du présent concours s'il estime, à sa seule discrétion, que le Soumission n'est pas conforme à ces lignes directrices et à ces restrictions.

En participant, les participants déclarent et garantissent que le Soumission qu'ils soumettent :

· est leur propre création originale;

· n'enfreint pas les droits d'une autre personne ou entité;

· n'a pas été soumis précédemment dans le cadre d'un concours ou d'une promotion de quelque nature que ce soit;

· ne contient aucune référence à des tiers identifiables ou à leur image, à moins que le consentement de ces personnes et de leurs parents ou tuteurs légaux, s'ils n'ont pas atteint l'âge de la majorité dans leur juridiction de résidence, n'ait été obtenu;

· ne donnera lieu à aucune réclamation, quelle qu'elle soit, y compris, mais sans s'y limiter, les réclamations pour violation, atteinte à la vie privée ou à la publicité; et

· n'est pas diffamatoire, n'est pas calomnieux, n'est pas pornographique ni obscène et, en outre, ne contient pas, ne représente pas, n'inclut pas, ne discute pas ou n'implique pas, sans s'y limiter, l'un ou l'autre des éléments suivants: nudité; consommation d'alcool/de drogue ou tabagisme; activité sexuelle explicite ou graphique, ou insinuations sexuelles; langage et/ou symboles grossiers, vulgaires ou offensants; caractérisations désobligeantes de tout groupe ethnique, racial, sexuel, religieux ou autre (y compris, mais sans s'y limiter, tout concurrent du commanditaire); contenu qui approuve, tolère et/ou discute de tout comportement ou conduite illégal, inapproprié ou risqué; les renseignements personnels des individus, y compris, sans s'y limiter, les noms, les numéros de téléphone et les adresses (physiques ou électroniques); les messages commerciaux, les comparaisons ou les sollicitations pour des produits ou des services autres que les produits du commanditaire; tous les produits, marques de commerce, marques et/ou logos identifiables de tiers, autres que ceux du commanditaire (tous les vêtements portés et/ou les produits apparaissant dans votre soumission ne doivent pas contenir de logos, de marques de commerce ou d'autres matériaux de tiers visibles, à moins que les autorisations appropriées n'aient été obtenues --- note : tous les produits, marques de commerce, marques et/ou logos de tiers identifiables pour lesquels l'autorisation n'a pas été obtenue par le participant doivent être brouillés de manière à être méconnaissables); une conduite ou d'autres activités contraires au présent règlement officiel; et/ou tout autre élément qui est ou pourrait être considéré comme inapproprié, inadapté ou offensant, le tout tel que déterminé par le commanditaire à sa seule et entière discrétion.

Les contributions doivent être soumises par le créateur original. Les Soumission créés par quelqu'un d'autre que vous mais soumis par vous seront disqualifiés. Vous devez être l'unique détenteur des droits d'auteur de tout Soumission soumis. En soumettant chaque, vous garantissez que vous êtes l'auteur et le détenteur des droits d'auteur de cet Soumission.

En participant, les participants accordent une licence non exclusive, mondiale, libre de droits et perpétuelle au commanditaire pour éditer, adapter, créer des œuvres dérivées, diffuser, publier et utiliser de toute autre manière tout ou partie des descriptions et/ou photo(s) et/ou vidéo(s) incluses dans Soumission, soumis, et peuvent les utiliser à des fins publicitaires, promotionnelles et/ou à toute autre fin dans tous les médias actuellement ou ultérieurement conçus dans le monde entier à perpétuité sans compensation supplémentaire, notification ou permission, sauf si la loi l'interdit. En participant à ce concours, les participants acceptent en outre de : (a) d'utiliser et d'afficher leur Soumission soumis, seul ou en combinaison avec d'autres et dans n'importe quelle taille, sur le site web du commanditaire et sur les sites web, les médias sociaux et les documents imprimés du commanditaire sans aucun frais ou autre forme de compensation due à tout moment et aussi longtemps que le commanditaire le souhaite; (b) de renoncer à tous les droits moraux sur leur Soumission en faveur du commanditaire (et de toute personne autorisée par le commanditaire à utiliser ce matériel); et (c) accepte de dégager le commanditaire et toutes les autres Entités du concours de toute responsabilité en cas de réclamations, dommages, responsabilités, coûts et dépenses résultant de l'utilisation de leur Soumission, y compris, mais sans s'y limiter, toute réclamation fondée sur les droits de publicité, la diffamation, l'atteinte à la vie privée, la violation des droits d'auteur, la violation des marques de commerce ou toute autre cause d'action liée à la propriété intellectuelle ou toute autre cause d'action quelle qu'elle soit. Les crédits, descriptions ou titres, le cas échéant, utilisés avec le Soumission sont à la seule discrétion du commanditaire.  Si la propriété d'un Soumission soumis est contestée de quelque manière que ce soit par une personne, le commanditaire peut disqualifier ce/cet(te) Soumission et cessera d'utiliser le Soumission.

Un accès en ligne et un compte de courrier électronique sont nécessaires pour participer au présent concours. De nombreuses bibliothèques publiques, commerces de détail et autres offrent un accès gratuit à des ordinateurs et un certain nombre de fournisseurs d'accès à Internet et d'autres sociétés proposent des comptes de messagerie électronique gratuits.

RESTRICTIONS DE PARTICIPATION : Il n'y a pas de limite au nombre de participations, mais une seule participation par projet et chaque projet présenté doit être unique. Chaque participant doit envoyer sa participation en son propre nom et ne pas utiliser l'adresse électronique d'une autre personne pour participer. La violation de cette limite (par exemple, la soumission de plus d'une (1) participation via une ou plusieurs adresses électroniques) entraînera l'annulation de toutes les participations après la participation initiale. Tous les documents de participation soumis, y compris des descriptions et/ou photo(s) et/ou vidéo(s) soumis, deviennent la propriété du commanditaire, et aucun ne sera reconnu ou retourné. Les participations automatisées (y compris, mais sans s'y limiter, les participations effectuées à l'aide d'un script, d'une macro, d'un robot ou d'un service de loterie) entraîneront la disqualification et toutes les participations effectuées par cette personne seront annulées. En cas de litige sur l'identité d'un participant, la participation sera considérée comme effectuée par le titulaire autorisé du compte de l'adresse électronique fournie sur le formulaire de participation. Le titulaire autorisé du compte est la personne physique à laquelle l'adresse électronique a été attribuée par un fournisseur d'accès à Internet, un fournisseur de services en ligne ou toute autre organisation responsable de l'attribution des adresses électroniques ou du domaine associé à l'adresse électronique en question. Les Entités du concours ne sont pas responsables des participations incomplètes, corrompues, déformées, défectueuses, inaccessibles, irrégulières, perdues, tardives ou mal acheminées, quelle qu'en soit la cause, y compris, mais sans s'y limiter, les vidéos qui ne peuvent pas être ouvertes ou visionnées par le commanditaire pour quelque raison que ce soit. Aucune participation d'un tiers ou par l'intermédiaire d'un service de loterie n'est autorisée. Toute personne qui tente ou encourage, directement ou indirectement, la saisie de coordonnées multiples ou fausses sous plusieurs identités, plusieurs comptes de courrier électronique, ou qui utilise un dispositif ou un artifice pour participer ou encourager, directement ou indirectement, des participations multiples ou fausses, telles que déterminées par le commanditaire, sera disqualifiée. Si, de l'avis du commanditaire, il existe des preuves suspectes ou réelles de falsification électronique ou non électronique de toute partie du présent concours, ou si un virus informatique, un bogue, une intervention non autorisée, une fraude, des difficultés techniques ou des défaillances compromettent ou corrompent ou affectent l'administration, l'intégrité, la sécurité, l'équité ou le bon déroulement du présent concours, et/ou si le présent concours n'est pas en mesure de se dérouler comme décrit dans le présent Règlement officiel, le commanditaire a le droit, à sa seule discrétion, de disqualifier toute personne qui altère le processus participation et d'annuler toute participation soumise de manière frauduleuse, et/ou d'annuler, de résilier, de modifier ou de suspendre le présent concours, et de procéder à un tirage au sort pour sélectionner le gagnant du prix parmi toutes les participations non suspectes reçues avant que des mesures ne soient prises, ou de toute autre manière jugée équitable et appropriée par le commanditaire.   

Les tarifs des messages et des données s'appliquent à l'utilisation de l'appareil mobile pour participer au concours. Votre opérateur de téléphonie mobile peut vous facturer la participation à ce concours via un appareil mobile. Assurez-vous de vérifier le plan de tarification de votre opérateur de téléphonie mobile pour les données et le service cellulaire avant de participer par le biais d'un appareil mobile. Tous les appareils mobiles ne disposent pas d'un accès à l'Internet sans fil et l'accès à l'Internet sans fil peut ne pas être disponible dans toutes les régions.

SÉLECTION DES GAGNANTS; CHANCES DE GAGNER ET QUESTION D’HABILETÉ : Les gagnants seront déterminés selon la procédure décrite ci-dessous.

Au cours de la phase d'évaluation, un panel de juges (les « juges ») désignés par le commanditaire évaluera chaque participation admissible sur la base des critères pondérés suivants :

Les juges attribueront une note (la « note ») à chaque participation. Les chances d'être sélectionné dépendront du calibre de chaque participation admissible. Les participants associés aux meilleures participations admissible sur la base de la note (telle que déterminée par les juges, à leur seule discrétion) seront tous sélectionnés comme gagnants admissibles. En cas d'égalité entre deux (2) participations admissibles ou plus sur la base de la note, le participant associé à la participation admissible - parmi toutes les participations admissibles à égalité - ayant obtenu la note le plus élevée pour le critère 1 (suivi, en cas de nouvelle égalité, par le critère 2, puis le critère 3, puis le critère 4) sera sélectionné comme gagnant admissible. En cas d'égalité parfaite sur la base de tous les critères, un nouveau jury sera désigné par le commanditaire pour départager les ex-aequo conformément à la procédure précédente. Toutes les décisions des juges sont finales.

NOTIFICATION DES GAGNANTS : Le gagnant sera notifié par courrier électronique, comme indiqué par le participant, et devra remplir et renvoyer une déclaration d'admissibilité et d’exonération de responsabilité/de responsabilité publicitaire (« déclaration et exonération »), ainsi que tout autre document supplémentaire demandé par le commanditaire dans un délai de cinq (5) jours ouvrables à compter de la réception ou dans un délai plus court indiqué dans les documents de notification du prix. En cas de non-conformité au présent règlement officiel et/ou si un gagnant potentiel ne peut être contacté par le commanditaire, le prix sera annulé et un autre gagnant pourra, à la seule discrétion du commanditaire et si le temps le permet, être sélectionné par des juges parmi les participations admissibles restantes. Sans limiter la portée de ce qui précède, les participants comprennent et acceptent que la signature du gagnant sur la déclaration et exonération (ou d'autres documents) sous forme électronique aura la même force juridique et le même effet qu'une copie papier signée à la main. 

PRIX :

1. Un (1) grand prix de 5 000 dollars canadiens en espèces (sous forme de chèque) sera attribué.

2. Un (1) deuxième prix de 3 000 $CAN en argent comptant (sous forme de chèque) sera attribué.

3. Un (1) troisième prix de 2 000 $CAN en argent comptant (sous forme de chèque) sera attribué.

4. Un (1) quatrième prix de 1 500 $CAN en argent comptant (sous forme de chèque) sera décerné.

5. Un (1) cinquième prix de 1 000 $CAN en argent comptant (sous forme de chèque) sera décerné.

6. Cinq (5) prix pour la sixième place, soit une glacière Yeti Tundra® 45 Hard Cooler (couleur charbon) (valeur au détail approximative de 400 $CAN par glacière Yeti Tundra® 45 Hard Cooler (couleur charbon) seront attribués.

Il n'y aura qu'un (1) seul prix par gagnant. Les prix perdus ou volés ne seront pas remplacés. La cession, le transfert, la conversion en espèces ou le remboursement en espèces ou la substitution du prix ne sont pas autorisés, mais le commanditaire se réserve le droit de remplacer le prix par un prix d'une valeur égale ou supérieure si le prix n'est pas disponible. Tous les détails du prix sont à la seule discrétion du commanditaire. Le gagnant accepte le prix « tel quel », et les participants reconnaissent par la présente que le commanditaire n'a pas fait et n'est en aucun cas responsable de toute garantie, représentation ou garantie, expresse ou implicite, en fait ou en droit, relative au prix, y compris les garanties expresses (le cas échéant) fournies exclusivement par un fournisseur de prix qui sont envoyées avec le prix. La valeur totale approximative au détail de tous les prix est de 14,500 $ CAD. Toute évaluation du/des prix mentionnée ci-dessus est basée sur les informations disponibles fournies au commanditaire et la valeur de tout prix attribué à un gagnant peut être déclarée à des fins fiscales comme l'exige la loi. Le(s) gagnant(s) sera(ont) seul(s) responsable(s) de toutes les taxes d'État, fédérales, provinciales, territoriales et locales associées à l'acceptation et à l'utilisation de tout prix attribué. Chaque participant reconnaît que le commanditaire n'est en aucun cas tenu d'attribuer plus de prix que le nombre de prix disponibles tel qu'indiqué dans le présent règlement officiel.

CONDITIONS GÉNÉRALES : Le commanditaire et ses agences ne font aucune déclaration et ne donnent aucune garantie de quelque nature que ce soit, y compris, mais sans s'y limiter, la déclaration de qualité marchande ou d'adéquation à l'usage prévu, en ce qui concerne tout élément du ou des prix. Ni les Entités du concours ni aucun fournisseur de services ne sont responsables de la transcription incorrecte ou inexacte des informations de participation, ou de toute erreur humaine ou autre, des dysfonctionnements techniques, des données perdues/retardées, des omissions, des interruptions, des suppressions, des défauts, des défaillances de tout équipement informatique, des logiciels, de l'incapacité d'accéder à tout service en ligne ou site web (y compris le site web du concours), ou de toute blessure ou dommage à l'ordinateur ou à l'appareil mobile des participants lié à ou résultant de la participation à ce concours. ATTENTION : TOUTE TENTATIVE DE LA PART D'UN PARTICIPANT OU DE TOUTE AUTRE PERSONNE D'ENDOMMAGER DÉLIBÉRÉMENT UN SITE WEB, DE FALSIFIER LE PROCESSUS D'INSCRIPTION, DE FRAUDER LE COMMANDITAIRE OU DE PORTER ATTEINTE AU FONCTIONNEMENT LÉGITIME DE CE CONCOURS PEUT CONSTITUER UNE VIOLATION DU DROIT PÉNAL ET CIVIL ET, SI UNE TELLE TENTATIVE EST FAITE, LE COMMANDITAIRE SE RÉSERVE LE DROIT DE COOPÉRER À LA POURSUITE DE CETTE PERSONNE OU DE CES PERSONNES ET D'EXERCER TOUS LES RECOURS POSSIBLES DANS LES LIMITES AUTORISÉES PAR LA LOI. Le fait de ne pas appliquer une disposition du présent règlement officiel ne constitue pas une renonciation à cette disposition. Si, pour quelque raison que ce soit, ce concours ou une partie de celui-ci ne peut être exécuté comme prévu, ou en cas d'infection par un virus informatique, de bogues, de falsification, d'intervention non autorisée, de fraude, d'action des participants, de défaillance technique ou de toute autre cause qui, de l'avis du commanditaire, corrompt ou affecte l'administration, la sécurité, l'équité, l'intégrité ou le bon déroulement de ce concours, le commanditaire se réserve le droit, à sa seule discrétion, d'annuler ce concours et/ou une partie de celui-ci et de ne pas attribuer le(s) prix mentionné(s) dans le présent document. En cas d'annulation, de résiliation ou de suspension, un avis sera publié sur le site web du concours. Les participations ne respectant pas toutes les règles sont susceptibles d'être disqualifiées. 

EXONÉRATION :  En participant à ce concours, chaque participant libère entièrement les Entités du concours et leurs administrateurs, dirigeants, agents et employés respectifs de toute responsabilité concernant les actions, réclamations, coûts, dettes, dépenses, frais, blessures, pertes ou dommages de toute nature découlant de la participation du participant à ce concours ("réclamations") ou y étant liés de quelque manière que ce soit. La présente décharge s'applique expressément à l'ensemble des réclamations, coûts, frais, blessures, pertes ou dommages de quelque nature que ce soit liés ou découlant de l'accès non autorisé à des informations d'identification personnelle fournies par le participant au cours du présent concours ou de leur divulgation, ainsi que de l'acceptation, de la possession, de l'utilisation ou de la mauvaise utilisation du ou des prix et, s'il est sélectionné en tant que gagnant potentiel, le participant accepte de signer et de remettre la déclaration et exonération avant de recevoir son prix .

LES PARTIES ACCEPTENT, RECONNAISSENT ET COMPRENNENT QUE LES ENTITÉS DU CONCOURS NE PEUVENT ÊTRE TENUES RESPONSABLES DES DOMMAGES INDIRECTS, ACCESSOIRES, CONSÉCUTIFS, SPÉCIAUX, PUNITIFS OU DE PERTES DE PROFIT. LES PARTIES CONVIENNENT, RECONNAISSENT ET COMPRENNENT QUE LA RESPONSABILITÉ TOTALE DES ENTITÉS DU CONCOURS POUR TOUTE QUESTION DÉCOULANT DE OU LIÉE AU PRÉSENT CONCOURS, QUE CE SOIT DE MANIÈRE CONTRACTUELLE, DÉLICTUELLE OU EN VERTU DE TOUTE THÉORIE DE RESPONSABILITÉ, NE DÉPASSERA PAS LE MONTANT DES FRAIS RÉELS ENCOURUS PAR LE PARTICIPANT DANS LE CADRE DE SA PARTICIPATION AU PRÉSENT CONCOURS.

RENONCIATION AU TITRE DE L'ARTICLE 1542 DE LA CALIFORNIE :  En participant au présent concours, chaque participant comprend et accepte qu'il renonce spécifiquement et expressément à tout droit en vertu de l'article 1542 du California Civil Code, ou de toute loi, règle, réglementation ou ordonnance fédérale, provinciale, territoriale, d’État ou municipale analogue (en tout ou en partie).  L’article 1542 stipule ce qui suit :

A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, AND THAT IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.

UNE EXONÉRATION GÉNÉRALE NE S'ÉTEND PAS AUX CRÉANCES QUE LE CRÉANCIER OU LA PARTIE QUI EXONÈRE NE CONNAÎT PAS OU DONT IL/ELLE NE SOUPÇONNE PAS L'EXISTENCE EN SA FAVEUR AU MOMENT DE L'EXÉCUTION DE L’EXONÉRATION, ET QUI, SI ELLES AVAIENT ÉTÉ CONNUES PAR LUI OU ELLE, AURAIENT SIGNIFICATIVEMENT AFFECTÉ SON RÈGLEMENT AVEC LE DÉBITEUR OU LA PARTIE EXONÉRÉE.

DROIT APPLICABLE/JURIDICTION/RÉSOLUTION DES LITIGES : Les participants acceptent que (a) tous les litiges, réclamations et causes d'action découlant de ou liés au présent concours ou à l'attribution des prix soient, dans toute la mesure permise par la loi, résolus individuellement, sans recours à aucune forme d’action collective, et exclusivement par les tribunaux situés dans la province de l'Ontario; et (b) toutes les réclamations, tous les jugements et toutes les récompenses soient limités aux frais réels encourus, y compris les frais associés à la participation à ce concours, mais en aucun cas aux honoraires d'avocat. Tous les problèmes et questions concernant la construction, la validité, l'interprétation et le caractère exécutoire du présent règlement officiel, les droits et obligations des participants, ou les droits et obligations du commanditaire dans le cadre de ce concours, seront régis et interprétés conformément aux lois de la province de l'Ontario, sans donner effet à un choix de loi ou à des règles de conflit de lois (que ce soit dans la province de l'Ontario ou dans toute autre juridiction), qui entraîneraient l'application des lois d'une juridiction autre que celle de la province de l'Ontario.

PUBLICITÉ; GÉNÉRALITÉS : Chaque participant accorde au commanditaire et à ses représentants une licence perpétuelle, mondiale et libre de redevances pour utiliser, diffuser, publier et utiliser de toute autre manière le nom du participant, le nom de sa compagnie, son adresse de résidence, l'adresse de sa société, ses déclarations concernant le présent concours, son image, sa photographie, sa vidéo, sa voix et/ou sa ressemblance à des fins publicitaires, promotionnelles et/ou à toute autre fin dans tous les médias actuels ou futurs, dans le monde entier et à perpétuité, sans compensation supplémentaire, notification ou permission, sauf si la loi l'interdit. Le présent concours et toutes les participations sont soumis à toutes les lois et règlements fédéraux, d’États, provinciaux, territoriaux et locaux applicables. Nul là où la loi l'interdit.

Le commanditaire se réserve le droit, à sa seule discrétion, d'ajuster les dates, délais et/ou autres mécanismes stipulés dans le présent règlement officiel, dans la mesure jugée nécessaire par le commanditaire, afin de vérifier la conformité d'un participant, d'une participation et/ou d'autres informations avec le présent règlement officiel, ou à la suite de problèmes techniques ou autre, ou à la lumière de toute autre circonstance qui, de l'avis du commanditaire, à sa seule discrétion, affecte la bonne administration du concours tel que prévu dans le présent règlement officiel, ou pour toute autre raison.

En cas de divergence ou d'incohérence entre les modalités et conditions du présent règlement officiel anglais et les divulgations ou autres déclarations contenues dans tout matériel lié au concours, y compris, mais sans s'y limiter, la publicité sur le lieu de vente, à la télévision, imprimée, en ligne ou autre, la version française du présent règlement officiel et/ou toute instruction ou interprétation du présent règlement officiel donnée par un représentant du commanditaire, les modalités et conditions du présent règlement officiel anglais prévaudront, régiront et contrôleront dans toute la mesure permise par la loi.
