Collectively, the “Notification Period”. In all cases, the computer of Sponsor (as defined below) is the official timekeeping device of this Sweepstakes.

ELIGIBILITY: The Repair Challenge Weekly Sweepstakes (“Sweepstakes”) is open only to legal residents of Canada (excluding Quebec) who are eighteen (18) years of age or older at the time of entry (“Entrant”). Employees and the immediate families, spouses and parents, in-laws, siblings and children and their respective spouses, regardless of where they reside, and members of the same household of such employees (whether or not related) of WD-40 Company (Canada) Ltd. (“WD-40 Company” or “Sponsor”) and its respective parents, divisions, affiliates, dealers, subsidiaries and advertising and promotion agencies, and companies involved in the implementation and execution of this Sweepstakes (collectively, the “Sweepstakes Entities”) are not eligible to enter or win the prize. Sweepstakes is void where prohibited by law

AGREEMENT TO THE OFFICIAL RULES: By participating in this Sweepstakes, each Entrant fully and unconditionally agrees to and accepts these “Official Rules” and the decisions of Sponsor, which are final and binding in all matters related to this Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein.

ENTRY SUBMISSION: During the Entry Period enter this Sweepstakes by visiting the Sweepstakes website, https://repairdontreplace.wd40.ca/ (“Sweepstakes Website”) and completing the free online entry form and uploading a project photograph(s) and/or video(s) in accordance with the instructions provided. Online access and an email account are required in order to participate in this Sweepstakes. Many public libraries, retail businesses and others offer free access to computers and a number of Internet service providers and other companies offer free email accounts.

ENTRY RESTRICTIONS: There is no limit on the number of entries per entry period, however, only one entry per project and each project entered must be unique. Each Entrant must submit on behalf of oneself and not use another person’s email address to enter. Violation of this limit (e.g., submission of duplicate project entries) will result in voiding of all entries after the initial entry. All entries become the property of Sponsor, and none will be acknowledged or returned. Automated entries (including but not limited to entries made using any script, macro, bot, or sweepstakes service) will result in disqualification and all entries by such person shall be void. In the event of a dispute over the identity of an Entrant, entry will be deemed made by the authorized account holder of the email address provided on the entry form. The authorized account holder is the natural person who is assigned to the email address by an Internet access provider, online service provider, or other organization that is responsible for assigning email addresses or the domain associated with the email address in question. Sweepstakes Entities are not liable for incomplete, corrupted, garbled, defective, inaccessible, irregular, lost, late or misdirected entries, regardless of cause, including without limitation, videos that cannot be opened or viewed by Sponsor for any reason. No third-party entry or entry through sweepstakes service permitted. Any individual who attempts or otherwise encourages, directly or indirectly, the entry of multiple or false contact information under multiple identities, multiple email accounts, or uses any device or artifice to enter or encourage, directly or indirectly, multiple or false entries, as determined by Sponsor, will be disqualified. If, in Sponsor’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of this Sweepstakes, or if a computer virus, bug, unauthorized intervention, fraud, technical difficulties, or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of this Sweepstakes, and/or this Sweepstakes is not capable of being conducted as described in these Official Rules, Sponsor shall have the right, at its sole discretion, to disqualify any individual who tampers with the entry process and to void any entries submitted fraudulently, and/or to cancel, terminate, modify or suspend this Sweepstakes, and conduct a random drawing to select the prize winner from all non-suspect entries received prior to action taken, or as otherwise deemed fair and appropriate by Sponsor.    

Message and data rates apply to use of mobile device for Sweepstakes entry. You may be charged by your wireless carrier for entering this Sweepstakes via mobile device. Be sure to check your wireless carrier's pricing plan for data and cell service before participating via mobile device. Not all mobile devices offer wireless Internet access; and, wireless Internet access may not be available in all areas.

SELECTION OF WINNERS; DRAWING, ODDS AND SKILL TESTING QUESTION:

A random drawing to determine the potential winner(s) of Entry Period 1 of this Sweepstakes will be held on Notification 1. A random drawing to determine the potential winner(s) of Entry Period 2 of this Sweepstakes will be held on Notification 2. A random drawing to determine the potential winner(s) of Entry Period 3 of this Sweepstakes will be held on Notification 3. A random drawing to determine the potential winner(s) of Entry Period 4 of this Sweepstakes will be held on Notification 4. A random drawing to determine the potential winner(s) of Entry Period 5 of this Sweepstakes will be held on Notification 5. A random drawing to determine the potential winner(s) of Entry Period 6 of this Sweepstakes will be held on Notification 6. A random drawing to determine the potential winner(s) of Entry Period 7 of this Sweepstakes will be held on Notification 7. All eligible entries received by Sponsor during the Entry Period will participate in that drawing.

The drawing will be conducted randomly by Sponsor at 5399 Eglinton Ave. West, Suite 214, Toronto, Ontario M9C 5K6. Odds of winning will depend on the total number of valid entries received during the Entry Period. In addition, such Entrant whose entry is drawn must correctly answer a mathematical skill-testing question in order to be eligible to be awarded a prize.

WINNERS NOTIFICATION: The winner will be notified by email as provided by Entrant and will be required to complete and return an Affidavit of Eligibility and Liability/Publicity Release (“Affidavit and Release”), and any other additional documents requested by Sponsor within three (3) days of receipt or such shorter time as may be indicated in the prize notification documents.  Upon notification, the selected Entrant, must, unaided, correctly answer a time-limited mathematical skill-testing question. In the event that such selected Entrant is unable to answer the skill-testing question correctly, Sponsor shall have the right to disqualify said Entrant and to randomly draw another eligible entry, and Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard. In the event of noncompliance with this requirement and/or if a potential winner cannot be contacted by Sponsor, the prize will be forfeited, and an alternate winner will be selected by another draw. Without limiting the foregoing, Entrants understand and agree that winner’s signature on the Affidavit and Release (or other documents) in electronic form shall have the same legal force and effect as a hand-signed paper copy of same. 

PRIZES: One (1) weekly prize of a WD-40 and Yeti branded 20 oz. Rambler cup with a mag slide lid will be awarded. There will be only one prize per winner per entry period. Lost or stolen prize will not be replaced. No assignment, transfer, conversion to cash or cash redemption or substitution of the prize is permitted, except Sponsor reserves the right to substitute the prize with a prize of comparable or greater value should the prize become unavailable. All prize details are at the sole discretion of Sponsor. The winner agrees to accept the prize “as is”, and Entrants hereby acknowledge that Sponsor has neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the prize, including express warranties (if any) provided exclusively by a prize supplier that are sent along with the prize. The approximate retail value of the prize of each WD-40 and Yeti branded 20 oz. Rambler cup with mag slide lid is $45CAD. Total approximate retail value of all prizes is $315CAD. Any valuation of the prize(s) stated above is based on available information provided to Sponsor and the value of any prize awarded to a winner may be reported for tax purposes as required by law. The winner(s) will be solely responsible for all applicable state, federal, provincial, territorial and local taxes associated with the acceptance and use of any awarded prize. Each Entrant acknowledges that Sponsor shall not be required under any circumstances to award more prizes than the number of available prizes as set out in these Official Rules.

GENERAL CONDITIONS: Sponsor and its agencies make no representation or warranty of any kind, including but not limited to the representation of merchantability or fitness for intended use, with regard to any elements of the prize(s). Neither Sweepstakes Entities nor any service providers are responsible for incorrect or inaccurate transcription of entry information, or any human or other error, technical malfunctions, lost/delayed data, omission, interruption, deletion, defect, failures of any computer equipment, software, inability to access any online service or website (including the Sweepstakes Website), or any injury or damage to Entrants’ computer or mobile device related to or resulting from participation in this Sweepstakes. CAUTION: ANY ATTEMPT BY ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE, TAMPER WITH THE ENTRY PROCESS, DEFRAUD SPONSOR, OR OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO COOPERATE IN THE PROSECUTION OF ANY SUCH INDIVIDUAL(S) AND TO PURSUE ALL REMEDIES TO THE FULLEST EXTENT PERMITTED BY LAW. Failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If for any reason this Sweepstakes or any part of it is not capable of being executed as planned, or infection by computer virus, bugs, tampering, unauthorized intervention, fraud, action of Entrants, technical failures or any other causes which, in the opinion of Sponsor, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion to cancel this Sweepstakes and/or any part of it and not award any of the prize(s) referenced herein. In the event of any cancellation, termination or suspension, notice thereof will be posted on the Sweepstakes Website. Entries not complying with all rules are subject to disqualification. 

RELEASE:  By participating in this Sweepstakes, each Entrant fully releases Sweepstakes Entities and their respective directors, officers, agents and employees, from any and all liability for any actions, claims, costs, debts, expenses, fees, injuries, losses or damages of any kind arising out of or in any way related to the Entrant’s participation in this Sweepstakes (“Claims”). This Release expressly applies to all claims, costs, fees, injuries, losses or damages of any kind relating to or arising out of unauthorized access to, or disclosure of, any personally identifiable information supplied by the Entrant during the course of this Sweepstakes as well as the acceptance, possession, use, or misuse of the prize(s) and, if selected as a potential winner, Entrant agrees to sign and deliver the Affidavit and Release before receiving his/her prize.

THE PARTIES AGREE, ACKNOWLEDGE AND UNDERSTAND THAT SWEEPSTAKES ENTITIES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR LOST PROFIT DAMAGES. THE PARTIES AGREE, ACKNOWLEDGE AND UNDERSTAND THAT SWEEPSTAKES ENTITIES’ TOTAL AGGREGATE LIABILITY FOR ANY MATTER ARISING FROM OR RELATED TO THIS SWEEPSTAKES, WHETHER IN CONTRACT, TORT, OR UNDER ANY THEORY OF LIABILITY, SHALL NOT EXCEED THE AMOUNT OF THE ACTUAL OUT-OF-POCKET COSTS INCURRED BY ENTRANT ASSOCIATED WITH ENTERING THIS SWEEPSTAKES.

CALIFORNIA SECTION 1542 RELEASE:  By participating in this Sweepstakes, each Entrant understands and agrees that he or she is specifically and expressly waiving any and all rights under Section 1542 of the California Civil Code, or any analogous (in whole or in part) federal, state, provincial, territorial or municipal law, rule, regulation or ordinance.  Section 1542 provides as follows:

A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, AND THAT IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.

GOVERNING LAW/JURISDICTION/DISPUTE RESOLUTION: Entrants agree that (a) any and all disputes, claims and causes of action arising out of, or connected with, this Sweepstakes or the awarding of the Prizes shall be resolved individually, without resort to any form of class action, and exclusively by the courts located in the Province of Ontario; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys’ fees. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, Entrants’ rights and obligations, or the rights and obligations of Sponsor in connection with this Sweepstakes, shall be governed by, and construed in accordance with, the laws of the Province of Ontario, without giving effect to any choice of law or conflict of law rules (whether of the Province of Ontario or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Province of Ontario.

PUBLICITY; GENERAL:  Each Entrant grants Sponsor and its designees a perpetual, worldwide, royalty-free license to use, broadcast, publish and otherwise use Entrant’s name, company name, address of residence, address of company, statements regarding this Sweepstakes, image, photograph, video, voice and/or likeness for advertising, promotional and/or any other purpose in any and all media now or hereafter devised worldwide in perpetuity without additional compensation, notification or permission, unless prohibited by law. This Sweepstakes and all entries are subject to all applicable federal, state, provincial, territorial and local laws and regulations. Void where prohibited by law.

ENTRANT'S PERSONAL INFORMATION: Information collected from Entrants is subject to WD-40 Company’s Privacy Policy and Terms of Use, available at https://wd40.ca/privacy-policy and https://www.wd40.com/terms-of-use. Information collected from Entrants may be used in subsequent marketing and promotions at WD-40 Company’s discretion.
